BATON ROUGE, La. — Louisiana’s Democratic attorney general says he will challenge the congressional health care legislation approved this weekend, a health overhaul that Gov. Bobby Jindal calls unconstitutional.
Attorney General Buddy Caldwell says he hasn’t decided whether Louisiana will join other states in currently pending lawsuits or file a separate lawsuit on behalf of the state. It’s unclear on what grounds Caldwell will argue against the health overhaul.
Jindal asserts states’ rights privileges and contends the federal government can’t require people to buy insurance.
State lawmakers — who begin their annual legislative session next week — will consider a bill that attempts to nullify parts of the health care legislation. Similar bills have been filed in more than 30 states.
